In order for any domestic Factory Distributor (“FD”) to be in compliance with the Kirby Insurance Policy Statement (June, 2010), the following documents must be received by the Contracts Department:
- Commercial General Liability Certificate/Acord for Business
- The Insured’s name and address on the certificate/Acord must match the Contracts Department’s records
- Policy Limits must be at least $1M per occurrence/accident
- The Kirby Company, 1920 West 114th Street, Cleveland, OH 44102 must be added to the policy as an additional insured
- Hired and Non-Owned Autos
- Can be added onto the Business General Liability Policy if FD does not have a Commercial Auto Policy
- Policy Limits must be at least $1M per accident
- If FD has a commercial auto policy, Hired and Non-Owned Autos coverage is usually on the Commercial Auto Policy
- Commercial Auto Policy Certificate/Acord
- The Insured’s name and address on the certificate/Acord must match the Contracts Department’s records
- If FD uses vehicles in his business, the FD must have a commercial auto insurance policy (a personal insurance policy will not suffice)
- Policy Limits must be at least $1M per accident
- The year, make, model and vin # of each vehicle insured must also be listed on the certificate of insurance/Acord
- The Kirby Company, 1920 West 114th Street, Cleveland, OH 44102 must be added onto the policy as an additional insured
- If the FD does not use any company owned vans or cars in the FD’s distributorship, the FD must provide a letter to The Contracts Department stating the same. (The letter must state that the FD does not use any company or personal owned vans or vehicles in the FD’s Distributorship, and in the event vehicles are used, the required insurance must be obtained by the FD. The FD dates, signs and places his FD number on this letter.)
- Workers’ Compensation Insurance
- Although workers’ compensation is not required, the Company strongly recommends that the FD obtain coverage limits of a minimum of $100,000.
- Employment Practices Liability Insurance (EPLI)
- The Company recommends that each FD procure and maintain in effect one or more policies of employment practices liability insurance with coverage limits of at least $50,000.
